Bankruptcy

In October 2005 the most comprehensive changes in bankruptcy law in a generation went into effect. The new laws will not prevent most people from obtaining bankruptcy relief but the process is more complex than it once was. It is crucial you have an attorney experienced in bankruptcy law represent you.

I have practiced bankruptcy law since 1986 assisting hundreds of individuals and families obtain a fresh start under Chapter 7, counseling small businesses and individuals in reorganizations under Chapter 11 and representing individuals and couples in Chapter 13 payment plans.

I also provide creditor representation in all bankruptcy cases, assisting landlords, secured creditors and unsecured creditors in obtaining payment on their claims, recovery of property, pursuit of challenges to discharge and defense to preference and fraudulent transfer claims.

Business Law

The best business idea will not succeed without good planning. I advocate a preventive approach to business problems - it is far better for business to anticipate the problem and properly prepare for it than simply react to the problem after it occurs.

I advise individuals and small businesses on business issues ranging from choice of entity (whether to form as a corporation, limited liability company or partnership), shareholder and owner agreements, internal governance, personal service contracts, review and negotiation of outside financing, purchase and sale of goods and assets, and sale or liquidation of the business.


Real Estate Law

Most residential real estate transactions do not require the services of an attorney. Your real estate agent should be working for you. If a problem arises during a sale, if you have a question that is not being answered or if you would feel more comfortable with a legal consultation, I can review your agreement, meet with you and answer your questions. You should ask before you close on the sale. Waiting until the sale closes may be too late.

My real estate practice consists of advising on residential real estate transactions, counseling tenants and landlords on commercial leases and litigating commercial eviction cases.
